Consumer Takes Honda Motor Co. To Small Claims Court

Los Angeles, CA — Unhappy with a class-action settlement against Honda Motor Co. Heather Peters has filed a suit in Small Claims Court. Peters is one of many consumers angry that her 2006 Honda Civic hybrid does not get the miles per gallon claimed by Honda Motor Co. The class-action settlement gives the lawyers $8.5 million and the owners of the Civics $100 each plus rebate coupons for the purchase of a new car. Peters decided to take her case to Small Claims Court in Torrance where under California law, attorneys are not allowed, only a representative from the company may come. She is asking for the maximum of $10,000. She is also encouraging other Civic owners to do the same with her website, DontSettleWithHonda.org. Peters’ court date is Jan. 3. I can’t wait to see how she does!

Lawsuit Filed Against Volusia County School District

Daytona Beach, CA — A lawsuit was filed Monday against the Volusia County school district. The suit claims that the district did not protect a student, Dondre Jones, from being bullied at school. The boys mom says that her son now suffers from depression as a result of the bullying. Dondre Jones attended Campbell and Holly Hill middle schools. He was kicked, punched, and his pants were pulled down by other boys. A teacher allegedly saw the incidents and did nothing. The boys took pictures of Dondre being bullied and threatened to put them on the internet. Dondre will be homeschooled for the rest of this school year. The district has not responded to the lawsuit.

Barry Bonds To Be Sentenced on Friday

San Francisco, CA –Barry Bonds will be sentenced on Friday for giving evasive testimony to a federal grand jury investigating sports doping. He may be given home confinement, put in prison for up to 15 months, or put on probation. U.S. District Judge Susan Illston has given other athletes convicted of lying probation and home confinement. Distributors of steroids have received prison sentences of up to four months. Bonds, the former San Francisco Giants homerun record holder, was tried for lying to a federal grand jury in 2003. The grand jury was investigating a laboratory that was selling banned substances to athletes. Bonds was convicted in April of one count of federal obstruction of justice for being evasive.

New York City, NY — Michal Lura Friedman and her husband, Jay Snyder, were excited to have kids. After trying to get pregnant for seven years Michal became pregnant with twins. She was scheduled for a C-section on Nov, 28, because one of the children was a breech baby. Two days before the scheduled delivery, Michal, 44, went to the hospital and her blood pressure was up. The doctor decided to deliver that day; the children were full-term, 38 weeks. Friedman delivered a 6-pound girl and a 7-pound boy, both healthy, with her husband in the room. Four hours later she began bleeding post operatively and was taken to ICU. The doctors tried to save her, but she died a short while later. The medical examiner will do an autopsy for a conclusive cause of death. The state Health Department is also investigating. These days C-sections are so common that some women have one even if they don’t have to. But, surgery is always a risk. Woman Granted $10 Million in Slip-and-Fall Lawsuit Against Wal-Mart

Denver, CO — The Colorado Supreme Court upheld a jury verdict Monday granting a truck driver nearly $10 million in her slip and fall accident claim against Wal-Mart. Holly Averyt, 41, of Cheyenne, Wyo., slipped and fell on ice and grease while making a delivery to a Wal-Mart store in northern Colorado. Averyt had to undergo three surgeries on her spine and was unable to go back to work. Her attorneys presented evidence that some grease from the deli in the store didn’t get trapped in a device designed to keep it from getting into the sewer. In November 2010 a jury awarded $15 million to Averyt, but Wal-Mart appealed. The Supreme Court threw out the grounds for a new trial and granted Averyt $10 million. Justices reduced the award amount by about $5 million because of a state cap on non-economic damages.

Man With Autism Wins Disability Discrimination Settlement

San Diego, CA — A San Diego hotel clerk with autism won a settlement from Comfort Suites regarding his disability discrimination lawsuit on Monday. The U.S. Equal Employment Opportunity Commission claimed that the clerk was denied a reasonable accommodation and was fired in 2008 due to his disability. Comfort Suites Mission Valley Hotel agreed to pay $132,500 to settle the suit. The clerk had worked at a different hotel previously and earned a positive review. When he was hired by Comfort Suites, he asked for a free job coach from the state to help him learn to master his job by using autism-specific training techniques. Comfort Suites did not allow him to have a job coach and later fired him. The EEOC filed suit on behalf of the clerk in September of 2010 in U.S. District Court in San Diego, alleging that the company violated the Americans With Disabilities Act. Tarsadia, the parent company of Comfort Suites, agreed to the monetary settlement and to revise its policies regarding workers with disabilities.
