			<content:encoded><![CDATA[<p id="yui_3_3_0_20_1322533167660299">Cleveland, OH &#8212; A third grader was removed from his home when state officials said his mother did not do enough to help him lose weight.  The boy who weighs more than 200 pounds was suffering from breathing problems and was diagnosed with sleep apnea last year. He was enrolled in a program called &#8220;Healthy Kids, Healthy Weight&#8221; through the Rainbow Babies &amp; Children&#8217;s Hospital, but social workers said his mother has not done enough to help him.  The juvenile court gave custody of the boy to the Department of Children and Family Services saying that his weight issue is a form of medical neglect.  A custody trial is set for next month to determine if the mother will regain custody.  The subject of the intervention of the state in the matter of childhood obesity is the subject of much debate. Dr. David Ludwig co-wrote with Lindsey Murtagh, a lawyer and researcher at Harvard’s School of Public Health, &#8220;In severe instances of childhood obesity, removal from the home may be  justifiable, from a legal standpoint, because of imminent health risks  and the parents’ chronic failure to address medical problems.&#8221;  To me this way of thought is opening a can of worms.  How many pounds over weight is too many, before you take away someone&#8217;s child?  Is the state prepared to absorb the cost for all the kids that would then be part of the system and provide the health care necessary?  I think the problem needs to be addressed in the schools and in the communities where people live.</p>

<p>The 8-year-old boy with severe autism ran away from Grandview Elementary School in Twin Peaks around 11 a.m. on Monday.  It is thought that he slipped through a gate when he was at the school&#8217;s playground.</p>
<p>About 60 searchers aided by dogs and helicopters, searched the area for the boy. The boy was dressed in only a polo shirt, shorts, and sandals which was a concern due to the lightning and heavy rain storm overnight.</p>
<p>Searchers found Joshua hiding behind a bush in a densely wooded forest area.  He was airlifted to a hospital for evaluation.  Joshua was in the care of Child Protective Services after being taken away from his parents three weeks before. His parents are fighting to regain custody of Joshua.</p>

<p>The parents, Justin Hamilton, 31, and Kristin Harris, 26, were charged with <a href="http://www.ilawyersource.com">child neglect </a>and possession of an illegal prescription drug.</p>
<p>The father said the family had been evicted from their apartment and simply fallen on hard times.  Business was slow and he was trying to do odd jobs to support the family.</p>
<p>Both parents have previous convictions.  The father has a previous conviction for cocaine and marijuana possession  in 2010, and Harris has a  previous conviction for shoplifting groceries and marijuana possession.  Both parents are being held on bond.</p>

<p>Judge Jim Isaacson of Chippewa County has approved a settlement of $775,000 for the family of Anthony Flott, who is now 7 years old.</p>
<p>The lawsuit states that the child was dropped at Sleepers to Sneakers child care center in 2004 when he was 5 months old. According to the lawsuit the baby slipped out of a caregiver&#8217;s arms when she tripped and hit his head on a concrete floor.</p>
<p>According to the suit the baby&#8217;s mother, Vicki Hodges, wasn&#8217;t told about the fall incident.  When she took her child home that night she had trouble waking him for a feeding.  She took her son to the hospital where doctors discovered he needed emergency brain surgery.</p>
