Caitlyn Jenner Sued for Negligence by Grammy Nominated Composer

Caitlyn Jenner is being sued for negligence by a family who suffered injuries in the fatal February crash that killed Kim Howe.

Los Angeles personal injury attorneys Panish Shea & Boyle filed suit against Jenner on behalf of grammy nominated Peter Wolf-Millesi, his wife Lea, the couple’s two minor children, and Lea’s mother Elga Maurer.

According to the firm’s site:  On February 7, 2015, Peter Wolf-Millesi was driving a Hummer H2 southbound on Pacific Coast Highway on the way to his eldest son’s tennis tournament. His wife Lea was seated beside him in the passenger seat, while his two sons and mother-in-law rode in the backseat. At the same time, Caitlyn Jenner, driving a Cadillac Escalade and towing a trailer with an all-terrain vehicle on it, was traveling northbound when she rear-ended a Lexus LS 430 driven by Howe. The Lexus was launched into oncoming traffic and collided head-on with the Wolf-Millesi’s vehicle. Jenner’s SUV continued forward, rear-ending a Toyota Prius driven by Jessica Steindorff before coming to a stop.

“All of a sudden a car comes into our lane from oncoming traffic and rushes onto our hood. We were shocked and terrified we were all going to die,” says Peter, recalling the crash. “When you’re involved in an accident that claimed the life of someone, you’re just not the same anymore. So many lives have been changed forever,” adds Lea.

In the suit, Peter Wolf-Millesi claims to have suffered sever nerve damage to his wrists and hands and – as a composer – has been unable to work.  Lea has suffered orthopedic trauma to her legs, neck, knees and back and will continue to have pain and physical limitations.   It also indicates that Maurer – Lea’s mother – suffered a C-spine “hangman’s fracture” in her neck.

In the suit, Wolf-Millesi claims he suffered nerve damage to both hands and wrists and has been unable to work. Lea allegedly suffered orthopedic trauma to her legs, neck, back and knees; she continues to have ongoing pain and physical limitations. The suit also states that Maurer suffered a C-spine “hangman’s fracture” in her neck.  A hangman’s fracture occurs when the neck is hyper extended and typically happens in car accidents when a person’s chin is slammed against the steering, dashboard, or windshield.

While investigators found that Jenner was traveling at a speed unsafe for traffic conditions, no vehicular manslaughter charge was filed.

Court Ruling Ends 20-Year Anna Nicole Smith Estate Battle

On Tuesday, a Texas appellate court likely closed the infamous 20-year dispute between the estate of J. Howard Marshall II and the late Anna Nicole Smith.

The decision, made by the First Court of Appeals, relieves the one-time Playboy Playmate’s estate of over $500,000 in sanctions she was ordered to pay her former son-in-law, E. Pierce Marshall, for filing a frivolous challenge to her deceased husband’s will. It comes 20 years after Marshall’s death and more than eight years after Smith’s death. Anna Nicole’s notability particularly grew during the prolonged court battle over Marshall’s estate, which prompted speculation she had married the investor for his money – claims she always denied.

The ruling also looks to have infinitely ended a complex legal struggle involving litigation in multiple states and two trips to the U.S. Supreme Court. The appeals court dismissed the sanctions against Anna Nicole Smith, stating Pierce Marshall had the onus of attaining a jury verdict on the amount of fees due, but the probate court simply set the amount without reason. The Court opinion regarding this case can be found here.

With the apparent end to this notoriously lengthy estate dispute, the importance of a properly crafted will cannot be emphasized enough. Contacting a Phoenix estate planning lawyer is your first step to ensuring your estate is distributed exactly the way you want after your death.

Jamie McCourt Petitions To Renegotiate The Divorce Settlement

Los Angeles, CA  —Former Dodgers owner Frank McCourt and his ex-wife are back in court.  Jamie McCourt has asked the court to set aside their divorce settlement, stating that her husband understated the value of the Dodgers.  Frank McCourt sold the Dodgers earlier this year for $2 billion, the highest price ever for a sports team.  Jamie McCourt said she tried to settle the dispute out of court, but was unsuccessful.  Jamie’s lawyer said that “Mr. McCourt got about 93 percent of the family assets, and Mrs. McCourt got about 7 percent.”  The motion was filed in Los Angeles Superior Court on Monday.  The couple’s divorce settlement was finalized in October 2010, with Jamie McCourt receiving $131 million.  Frank McCourt is said to be worth about $1.7 billion.  A hearing on the motion to set aside the divorce settlement is scheduled for Nov. 16.  If you are in the midst of a divorce, get the help of a Los Angeles divorce attorney to protect your rights.

Validity Of Michael Jackson’s Will Questioned By Some Family Members

Los Angeles, CA — Michael Jackson’s youngest brother and three of his siblings have called Michael Jackson’s will a fake.  Randy Jackson wrote a letter to the Jackson estate executors, asking them to resign.  The one thing he hasn’t done is challenge the will in court.  The only people who received money in Michael’s will were his mother and his three children — Prince, 15; Paris, 14; and Blanket, 10.  Experts say even if the will was invalid, there would be no change in how the money has been distributed. California law requires the estate to benefit the children.  The will signed in 2002 is a five-page document and many provisions are set out in a trust.  The will was signed on July 7, 2002 in Los Angeles with the signatures of three witnesses.  The problem is there is proof that Michael Jackson was in New York on that day and not in Los Angeles.   Any challenge to the will should have been filed within four months of it being accepted into probate.  That occurred in November of 2009.  If you have a significant amount of wealth, it is important that you prepare a will or trust, so your estate is distributed the way you want after your death.  Contact a Los Angeles estate planning attorney to draw up your will.
