Irvine, CA –A Laguna resident is suing Irvine BMW, BMW of North America Inc., and Goldenwest Recovery Services Inc. for fraud, assault and false imprisonment. Albert Scott Arditi claims that he stopped making his loan payments on his 2004 BMW 745i because the dealership did not fix the serious mechanical problems that the car developed right before his six-year warranty ended. The dealership sent a repossession agent to seize the car and in the process he was attacked and held down. Arditi had missed about five payments when his car was repossessed. When he tried to get his belongings from the glove compartment, He was physically attacked by a Golden West employee. Police investigated the incident, but declined to prosecute the employee due to insufficient evidence. Arditi is asking for $214,100 in damages which includes $80,000 to replace the car. Neither BMW nor Golden West has responded in court to the federal lawsuit despite a 21-day deadline.
