Hydroxycut Lawsuit Filed in Canada
CANADA – A class action lawsuit was filed in Canada against the manufacturer of the weight-loss aid drug Hydroxycut.
The lawsuit comes less than a week after a recall was issued on all Hydroxycut products because of liver damage and other injuries that might result from its use.
The suit claims that the manufacturer failed to provide warnings and properly label the product as unsafe.
The recall was issued on May 1, 2009 by the FDA and told consumers to stop using the product because of reports that the weight-loss aid caused 23 people to develop serious liver problems.
The class action suit was filed by a Toronto attorney on behalf of all Canadians who bought and used Hydroxycut after May 1, 2003.
“The failure to state [on the label] that Hyrydroxycut use could effect your cardiovascular, respiratory, gastrointestinal, neurological systems as well as your liver and kidneys, is an omission of important risk information, and as such, is a false, misleading and/or deceptive representation that deceives or tends to deceive consumers into believing that their consumption of such Hydroxycut has no adverse effect on the above mentioned,” the complaint stated.
